Version 2026-08-10 - effective August 10, 2026
These Terms govern electronic services provided by ConsultIT Michał Giernatowski, a sole proprietor registered in CEIDG, address: ul. Alpaki 20, 05-506 Lesznowola, Polska, NIP: 5361887961, REGON: 384671455 ("Provider"). Contact: Help@anset.ai.
The Service agreement is formed when you create an Account and affirmatively accept the Terms. The Terms are made available free of charge before contracting in a form that can be saved and reproduced.
This document is a translation of the legally binding Polish version of the Terms of Service. In case of any discrepancies between the Polish and English versions, the Polish version shall prevail.
The Service is intended for users who are at least 18 years old. By creating an Account, you represent and warrant that you are at least 18 years of age and have full legal capacity to enter into these Terms.
If you are using the Service on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms.
anset.ai is an AI-powered image composition platform for marketing agencies and content creators. The Service provides:
The quality, style, and accuracy of AI-generated outputs may vary. The Provider does not guarantee that generated content will meet the User's specific expectations or requirements.
The Service may allow uploading product photos, scenes, brand assets, and other reference materials. Such materials may accidentally or intentionally include a person's likeness, trademarks, works, or other third-party rights. The User is responsible for ensuring that every uploaded material may be lawfully processed and used in the Service.
To use the Service, you must register an Account by providing a valid email address and password, or by authenticating through a supported third-party provider (Google OAuth).
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your Account. You must notify us immediately at legal@anset.ai of any unauthorized use of your Account.
You must provide accurate and complete information during registration and keep it up to date. The Provider reserves the right to suspend or terminate Accounts that contain false or misleading information.
The Service offers the following subscription plans:
Payments are processed by the Stripe group entity identified in the checkout or Stripe terms ("Stripe"). The Provider does not store full payment-card credentials; Stripe collects and processes those credentials directly.
Subscriptions are billed for the period and in the currency clearly shown before purchase. By subscribing, you authorize recurring charges to your payment method at the beginning of each billing period.
Subscription Credits are allocated upon successful payment of each invoice. Unused Subscription Credits do not roll over to the next billing period.
Taxes may be added to the price where required based on the User's country, region, tax status and place of residence or establishment. The final amount, currency and applicable taxes are displayed before the order is placed.
The User must provide accurate and current billing information, including country, address and, where applicable, a valid tax identification number. An incorrect, invalid or unverifiable tax number may result in applying the rules applicable to a User without verified business status.
Invoices are issued electronically, including through the Polish National e-Invoicing System (KSeF) where required or permitted by applicable law. The invoice or its readable representation is made available in the Account, sent to the provided email address or delivered in another agreed manner. If KSeF is unavailable, an invoice may be issued and delivered using a procedure permitted by law.
Before purchasing a Subscription or Credit Pack, the User receives information about price, currency, taxes, billing period, number of Credits, renewal rules, and cancellation method. Information shown in checkout at the time of purchase forms the terms of that order.
If a Consumer requests that performance of the digital service begin before the withdrawal period expires, they make a statement in checkout containing that request and acknowledging that they will lose the right of withdrawal once the service has been fully performed, and that if they withdraw earlier they will pay for the service provided until withdrawal. We send confirmation of the contract, including the text of this statement, on a durable medium by email.
Until the statutory conditions for losing the right of withdrawal are met, the Consumer retains rights arising from mandatory law. No-refund provisions limit neither Consumer withdrawal rights nor remedies for non-supply or lack of conformity of a digital service or digital content.
The Service operates a dual-pool credit system:
Credit costs vary based on the AI model used, image quality setting, aspect ratio, and generation type. Current pricing is available in the Service interface and via the API.
Credits are a virtual unit of account within the Service. They have no monetary value outside the Service, cannot be transferred to other users, exchanged for cash, or redeemed in any other way.
The following one-time Credit Packs are available for purchase:
Purchased Credits do not expire and remain available for as long as the Account exists.
Credit Pack purchases are non-refundable, except where required by applicable consumer protection law (see Section 10).
Upgrades take effect immediately. You will be charged a prorated amount for the remainder of the current billing period, and your Credit allocation will be adjusted accordingly.
Downgrades take effect at the end of the current billing period. You will retain access to your current plan's features and Credit allocation until that date.
You may cancel your Subscription at any time through your Account settings. Cancellation takes effect at the end of the current billing period. No further charges will be made after cancellation.
If a recurring payment fails, your Subscription status will be set to "past due." Stripe will automatically retry the payment. During this period, Subscription Credits will not be refreshed, but your Purchased Credits remain available. If all payment retries fail, your Subscription will be canceled and your plan will revert to the free tier.
If you are a Consumer within the European Union, you have the right to withdraw from a distance contract within 14 days of its conclusion, without giving any reason, unless the law provides an exception and all required conditions have been met.
The Service is a digital service. If before purchase you requested that performance begin before the withdrawal period expires and you then withdraw, you will pay an amount proportionate to what was provided until you informed us of your withdrawal (Article 35 of the Polish Consumer Rights Act). The amount is calculated from the contract price in proportion to the Credits used from the Credit Pack or from the current subscription period's allocation. We refund the rest of the price.
The right of withdrawal expires once the service has been fully performed, provided that before performance began you gave your express prior consent to it and acknowledged that you would lose the right of withdrawal once the service was fully performed. A Credit Pack service is fully performed once all of its Credits have been used. Merely using the app, clicking a generation button, or accepting the Terms at registration does not replace these statements.
You can submit a withdrawal statement through the form in billing settings, by email to legal@anset.ai, or to the Provider's address. The model withdrawal form is included in your purchase confirmation email. We confirm receipt of a statement submitted through the form by email without delay. Refunds are made within 14 days of receiving the statement, using the same means of payment. This does not limit remedies for lack of conformity of the service.
Model statement (optional): I, [name], address [address], hereby withdraw from the contract for [plan/pack] concluded on [date]. Date and signature — signature only for paper copies.
Users may submit complaints regarding the Service by sending an email to legal@anset.ai. Complaints should include: your Account email, a description of the issue, and the date the issue occurred.
The Provider will acknowledge receipt of the complaint within 3 business days and provide a substantive response within 14 calendar days of receipt.
Consumers may obtain free assistance from a municipal or district consumer ombudsman and use a competent consumer ADR entity, including the Polish Trade Inspection. The EU ODR platform was discontinued on July 20, 2025.
All images and creative materials generated through the Service are produced by artificial intelligence models. You acknowledge that:
As between you and the Provider, you retain rights in Inputs. To the extent the Provider acquires transferable rights in AI Content, it assigns them to you upon generation and payment; otherwise it grants a non-exclusive, worldwide, perpetual license for personal and commercial use. This does not guarantee copyright protection or exclusive output in every jurisdiction.
You are solely responsible for ensuring that your use of AI-generated content complies with applicable laws and regulations in your jurisdiction, including intellectual property, advertising, and data protection laws.
The Provider processes Inputs and AI Content as needed to provide, secure and maintain the Service. We do not use private images or prompts to train our own models without separate, voluntary consent; we may use irreversibly aggregated technical statistics.
The Provider does not guarantee that AI Content will be free from similarity to existing people, products, brands, works, styles, or protected materials. Before publishing or commercial use, the User must independently review the output for copyright, trademarks, personality rights, advertising rules, AI labelling, and sector-specific laws.
You must not remove, hide, or circumvent AI Markings, provenance metadata, or information about artificial origin if added by the Service or required by law, a publishing platform, or a client contract.
The Service, including its source code, design, user interface, AI models, algorithms, documentation, and trademarks, is the intellectual property of the Provider or its licensors. Nothing in these Terms grants you any right to the Provider's intellectual property beyond the limited right to use the Service as described herein.
You retain all rights to content you upload to the Service (reference images, product photos, brand assets). By uploading content, you grant the Provider a limited, non-exclusive license to process, store, and display such content solely for the purpose of providing the Service.
The legal status of intellectual property rights in AI-generated content is evolving and may vary by jurisdiction. The license granted in Section 12 represents the maximum rights the Provider can grant. You are responsible for assessing IP rights in your jurisdiction before commercial use.
By submitting User Content, you represent and warrant that you have all rights, licences, consents, and lawful bases required to upload, store, process, modify, analyse, use it as AI reference material, and use outputs for personal or commercial purposes.
If User Content contains an Identifiable Person, including a person visible in a product photo, scene, packaging, brand material, or background, you represent and warrant that you have the appropriate consent, model release, licence, or other lawful basis covering processing by the Service and the intended use of outputs.
You grant the Provider a limited, non-exclusive, worldwide licence to host, store, copy, display, analyse, modify, and process User Content solely as necessary to provide, secure, maintain, bill, and enforce the Service and comply with legal obligations.
You do not grant the Provider the right to sell your private User Content or train our own models on private images or prompts without separate, voluntary consent, unless the data has been irreversibly anonymised or aggregated into technical statistics.
The Service uses AI systems to generate and modify images, text, and layouts. Transparency obligations under Article 50 of Regulation (EU) 2024/1689 apply from August 2, 2026 to the extent required by law.
To the extent technically feasible and legally required, the Provider may add AI Markings to outputs, including machine-readable labels or metadata. The availability and persistence of such markings depends on file format, export method, publishing platform, and further file processing.
The User is responsible for visibly disclosing artificial generation or manipulation when publishing a deepfake, material realistically depicting persons, objects, places, events, or entities that could falsely appear authentic, or where required by law, publishing platform rules, client contracts, or advertising industry rules.
The Service uses Google models, including Gemini, through Vertex AI or the paid Google AI API. The parties' roles and obligations depend on the model, deployment, and use case; these Terms do not determine their legal classification.
You agree not to use the Service to:
The Provider may use automated and manual review of User Content, prompts, images, and outputs where necessary for safety, abuse prevention, enforcement of the Terms, protection of third-party rights, and legal compliance. Review may include image classification, face detection, or other risk-category detection, but is not intended to identify a person or create biometric templates.
We may refuse generation, block an asset, mark it for review, remove content, limit Account features, or suspend an Account where there is reasonable suspicion of a violation of the Terms, law, or third-party rights. The User may contest a block by contacting legal@anset.ai.
Credits reserved for a generation that was not performed due to technical reasons on the Service side are returned. Credits consumed or blocked in connection with a Terms violation may be non-refundable to the extent permitted by law, without limiting mandatory Consumer rights.
For business Users, the Service is provided as available without warranties beyond those expressly agreed. For Consumers, the Provider remains responsible for supply and conformity of digital content and services under mandatory applicable law.
To the maximum extent permitted by applicable law, the Provider's total aggregate liability for any and all claims arising from or related to the Service shall not exceed the total amount paid by you to the Provider in the 12 months immediately preceding the event giving rise to the claim.
The Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity, even if advised of the possibility of such damages.
The Provider is not liable for disruptions caused by force majeure events, including but not limited to: natural disasters, wars, pandemics, government actions, failures of third-party services (Google Cloud, Stripe, Supabase), internet outages, or cyberattacks.
The limitations in this section do not apply to liability that cannot be excluded or limited under mandatory applicable law, including liability for intentional damage and, for Consumers, liability under mandatory consumer protection provisions.
The Provider endeavors to ensure the Service is available 24/7 but does not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:
The Provider is not responsible for losses from temporary unavailability to the extent permitted by law. If a generation job fails due to a Service outage, reserved Credits are automatically returned.
Consumers are entitled to supply and conformity of digital content and services. For lack of conformity they may require conformity and, where law provides, a price reduction or termination; refunds are made within the statutory period.
We provide updates, including security updates, needed to maintain conformity for the period required by law. Consumers should install updates made available where their environment requires it.
The Service may be modified beyond what conformity requires only for a valid reason stated in the Terms and without additional Consumer cost. We give durable-medium notice of a non-minor negative change; the Consumer may terminate without charge within the period provided by law.
You may terminate your Account at any time by using the account deletion feature in Settings or by contacting legal@anset.ai. Upon deletion, your data will be removed in accordance with our Privacy Policy.
The Provider may suspend or terminate your Account immediately and without prior notice if you materially violate these Terms, including the Acceptable Use policy. In cases of non-material breach, the Provider will give you 7 days' written notice to remedy the breach before termination.
When the agreement ends, access to the Service ends. Export needed content before deleting the Account. Treatment of unused Credits depends on the reason for termination and mandatory law; Consumers retain statutory refund claims. Rights in previously generated content survive, and data is deleted or retained under the Privacy Policy.
Terms may change for a valid reason: changes in law or authority decisions, security, technology or suppliers, features, billing model, or abuse prevention. We will state the reason and give notice on a durable medium at least 30 days in advance unless law or an urgent security risk requires less notice.
If you do not agree with the amended Terms, you may terminate your Account before the effective date. Where law or the nature of a material change requires agreement, we will request affirmative acceptance; otherwise continued use after the effective date confirms acceptance to the extent permitted by law.
Non-material changes (typographical corrections, clarifications that do not alter your rights or obligations) may be made without advance notice.
These Terms are governed by and construed in accordance with the laws of the Republic of Poland.
For business Users, courts competent for the Provider's registered office have exclusive jurisdiction unless mandatory law provides otherwise.
For Consumers, disputes shall be submitted to the court having jurisdiction over the Consumer's place of residence, in accordance with mandatory provisions of applicable law.
Nothing in these Terms limits the rights of Consumers under mandatory provisions of the law of the country in which they are habitually resident.
